1. Acceptance of Terms

By accessing our website (om-mobile.pro), placing an order, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, along with our Privacy Policy and Refund Policy. If you do not agree with any part of these terms, you must not use our services.

These terms apply to all visitors, customers, and users of our services. We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services following any changes constitutes acceptance of those changes.

2. Service Description

2.1 Overview

Oman Mobile Pro provides prepaid tourist SIM cards and mobile telecommunications services specifically designed for international travelers visiting the Sultanate of Oman. Our services include:

  • Prepaid SIM cards with pre-configured data, voice, and SMS allowances
  • Mobile data connectivity via Omani telecommunications networks (Omantel and Ooredoo)
  • Voice calling services within Oman and internationally (where specified)
  • SMS messaging services
  • Airport pickup and delivery services
  • Customer support for tourists

2.2 Service Limitations

Our services are subject to the following limitations:

  • Availability of network coverage provided by third-party telecommunications operators
  • Device compatibility (unlocked GSM phones only)
  • Compliance with Omani telecommunications regulations
  • Geographic limitations (services operate within Oman only)
  • Time-limited validity periods as specified in each plan
  • Fair use policies regarding data consumption

3. Eligibility and Registration Requirements

3.1 Age Requirement

You must be at least 18 years of age to purchase and use our services. By making a purchase, you represent and warrant that you meet this age requirement.

3.2 Valid Identification

In accordance with Omani telecommunications regulations, all SIM card users must provide valid identification:

  • Valid passport (for international tourists)
  • Accurate personal information (full name, nationality, date of birth)
  • Contact information (email address, phone number)
  • Travel details (arrival date, accommodation information)

Providing false, misleading, or inaccurate information may result in immediate service termination without refund and potential legal consequences under Omani law.

3.3 Device Compatibility

Your device must meet the following requirements:

  • Unlocked GSM-compatible phone (not carrier-locked)
  • Support for frequencies used in Oman (GSM 900/1800 MHz, 3G 2100 MHz, 4G LTE, 5G where applicable)
  • Working SIM card slot

We are not responsible for compatibility issues with locked or incompatible devices. Customers should verify device compatibility before purchase.

4. Orders and Payments

4.1 Placing Orders

When you place an order through our website or at our physical locations:

  • You make an offer to purchase the selected products at the stated price
  • All orders are subject to acceptance and availability
  • We reserve the right to refuse or cancel any order for any reason
  • Order confirmation does not guarantee acceptance

4.2 Pricing

  • We are not liable for any delays or failures resulting from payment issues

5. Delivery and Activation

5.1 Delivery Methods

We offer the following delivery options:

  • Airport Pickup: Available 24/7 at Muscat International Airport Terminal 1
  • Hotel Delivery: Delivery to specified hotel addresses in Muscat and major tourist areas (typically within 24 hours)
  • Courier Delivery: Delivery to any address in Oman (2-3 business days)

5.2 Delivery Timeframes

Estimated delivery times are approximations and not guaranteed. We are not liable for delays caused by:

  • Customs or security procedures
  • Incorrect delivery information provided by customer
  • Recipient unavailability
  • Natural disasters, strikes, or other force majeure events
  • Public holidays or weekends affecting courier services

5.3 SIM Card Activation

  • SIM cards typically activate within 2-5 minutes of insertion
  • Activation requires device restart in some cases
  • Full registration with network operators may take up to 24 hours
  • Services begin upon successful activation
  • Validity periods commence from activation date, not purchase date

5.4 Activation Support

Our customer support team provides activation assistance 24/7. If you experience activation issues, contact us immediately for troubleshooting.

6. Service Plans and Usage

6.1 Plan Features

Each service plan includes specific features:

  • Data allowance (unlimited with fair use policy or specific GB amounts)
  • Voice calling minutes (local and/or international)
  • SMS messaging (local and/or international)
  • Validity period (7, 15, or 30 days as specified)
  • Network priority level (standard or premium)

6.2 Fair Use Policy

Plans advertised as "unlimited" are subject to fair use policies:

  • Data speeds may be reduced after excessive usage (typically 50GB+ daily)
  • Services are for personal use only, not commercial resale or hotspot distribution to multiple users
  • Activities that degrade network performance for other users may result in service restriction
  • Automated data transfer, torrenting, and server hosting are prohibited

6.3 Network Coverage

Network coverage is provided by third-party telecommunications operators (Omantel and Ooredoo):

  • Coverage maps are estimates and actual coverage may vary
  • Service quality depends on location, weather, terrain, and network congestion
  • We are not liable for coverage gaps or service interruptions caused by network operators
  • Remote areas, wadis, and certain geographic locations may have limited or no coverage

6.4 Service Validity

  • Services expire on the date specified in your plan (7, 15, or 30 days from activation)
  • Unused services, data, or minutes do not carry over or refund upon expiration
  • No partial refunds for unused portions of expired plans
  • Reactivation after expiration requires purchase of a new plan

7. Acceptable Use Policy

7.1 Prohibited Activities

You agree not to use our services for:

  • Any illegal activities or purposes prohibited under Omani or international law
  • Transmitting unlawful, threatening, abusive, defamatory, or obscene content
  • Distributing viruses, malware, or other malicious code
  • Unauthorized access to computer systems or networks (hacking)
  • Spamming, phishing, or fraudulent communications
  • Copyright or intellectual property infringement
  • Harassment, stalking, or threatening behavior
  • Operating servers, reselling services, or commercial redistribution
  • Activities that interfere with or disrupt network services

7.2 Consequences of Violation

Violation of this Acceptable Use Policy may result in:

  • Immediate service suspension or termination without refund
  • Reporting to law enforcement authorities
  • Legal action to recover damages
  • Permanent ban from future service use

8. Customer Responsibilities

As a customer, you are responsible for:

  • Maintaining the security and confidentiality of your SIM card and PIN
  • All activities and charges occurring on your account
  • Immediately reporting lost or stolen SIM cards
  • Ensuring device compatibility before purchase
  • Providing accurate registration and delivery information
  • Complying with Omani laws and regulations
  • Respecting local customs and telecommunications usage norms
  • Proper disposal of SIM cards when no longer needed

9. Limitation of Liability

Important Legal Notice: Please read this section carefully as it limits our liability to you.

9.1 Service Availability

We strive to provide continuous service but do not guarantee uninterrupted access. We are not liable for:

  • Network outages or service interruptions beyond our control
  • Telecommunications operator maintenance or technical issues
  • Coverage limitations in remote or underground areas
  • Service degradation due to weather, natural disasters, or force majeure
  • Government-mandated service restrictions or shutdowns

9.2 Maximum Liability

To the maximum extent permitted by law:

  • Our total liability for any claim related to our services shall not exceed the amount you paid for the affected service
  • We are not liable for indirect, incidental, special, consequential, or punitive damages
  • We are not liable for lost profits, lost data, business interruption, or lost opportunities
  • We are not liable for damages resulting from your inability to use services

9.3 Third-Party Services

We are not responsible for:

  • Third-party network operators' performance or service quality
  • Third-party websites, apps, or services accessed using our connectivity
  • Content accessed, transmitted, or stored using our services
  • Actions of other users or third parties

9.4 Device Damage

We are not liable for any damage to your device resulting from:

  • SIM card installation or removal
  • Software configuration or updates
  • Incompatibility issues
  • Normal wear and tear

10. Warranties and Disclaimers

10.1 Service Warranties

We warrant that:

  • SIM cards will be functional upon delivery
  • Services will substantially conform to descriptions provided
  • We will make reasonable efforts to resolve technical issues

10.2 Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED ABOVE, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability or fitness for a particular purpose
  • Non-infringement of intellectual property rights
  • Warranties regarding accuracy, reliability, or completeness
  • Warranties that services will be uninterrupted or error-free
  • Warranties regarding specific coverage areas or data speeds

11. Indemnification

You agree to indemnify, defend, and hold harmless Oman Mobile Pro, its officers, directors, employees, agents, and partners from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of our services
  • Your violation of these Terms & Conditions
  • Your violation of any laws or regulations
  • Your violation of any third-party rights
  • Any content you transmit using our services

12. Termination

12.1 Termination by Customer

You may terminate services at any time by:

  • Ceasing use of the SIM card
  • Allowing the service validity period to expire naturally
  • Contacting customer support to request early termination

Early termination does not entitle you to refunds for unused services except as specified in our Refund Policy.

12.2 Termination by Company

We reserve the right to suspend or terminate your services immediately without notice if:

  • You violate these Terms & Conditions
  • You provide false or fraudulent information
  • You engage in prohibited activities
  • You fail to pay amounts owed
  • We are required to do so by law or regulatory authority
  • Continued service would cause harm to us, other customers, or third parties

12.3 Effects of Termination

Upon termination:

  • Your access to services ceases immediately
  • All licenses and rights granted to you terminate
  • You remain liable for all charges incurred before termination
  • Provisions intended to survive termination remain in effect (payment obligations, limitation of liability, indemnification)

13. Intellectual Property

13.1 Our Intellectual Property

All content on our website and in our marketing materials, including but not limited to:

  • Trademarks, logos, and brand names
  • Website design, layout, and graphics
  • Text, images, videos, and multimedia content
  • Software, code, and databases
  • Documentation and user guides

are owned by or licensed to Oman Mobile Pro and protected by intellectual property laws. You may not use, reproduce, modify, distribute, or create derivative works without our express written permission.

13.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our website and services for personal, non-commercial purposes in accordance with these terms.

14. Privacy and Data Protection

Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms & Conditions by reference. By using our services, you consent to our data practices as described in the Privacy Policy.

15. Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of the Sultanate of Oman, without regard to conflict of law principles.

15.3 Jurisdiction

Any legal action or proceeding arising from these terms shall be brought exclusively in the courts of Muscat, Sultanate of Oman. You consent to the personal jurisdiction of these courts.

15.4 Arbitration

For disputes that cannot be resolved informally, both parties agree to attempt resolution through binding arbitration in accordance with Omani arbitration laws, before resorting to litigation.

16. Force Majeure

We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters (earthquakes, floods, storms)
  • War, terrorism, civil unrest, or government actions
  • Strikes, labor disputes, or supplier failures
  • Telecommunications or internet service failures
  • Power outages or infrastructure failures
  • Pandemics or public health emergencies

17. Severability

If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Waiver

Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Oman Mobile Pro.

19. Assignment

You may not assign, transfer, or delegate these Terms & Conditions or your rights and obligations without our prior written consent. We may assign these terms to any successor or affiliate without your consent.

20. Entire Agreement

These Terms & Conditions, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Oman Mobile Pro regarding our services and supersede all prior agreements, understandings, and communications.

21. Language

These Terms & Conditions are provided in English. In case of any translation, the English version shall prevail in case of discrepancies.
